of alcohol intoxication

As previously discussed, once you have
been stopped/contacted by a police
officer/sheriff’s deputy and he/she
smells the odor of an alcoholic beverage
coming from your breath or person,
or from inside the vehicle generally,
or for some other reason (like your
driving pattern) suspects that you
have consumed alcoholic beverages and/or
drugs and are driving while under the
influence, he/she will start to look
for other indicators (referred to as
“objective symptoms”) to substantiate
the belief that you are DUI.
Some of these additional indicators
are:
- Bloodshot/red/watery eyes
- Flushed face
- Slurred/slow speech
- Speaking too softly, loudly, or
incoherently
- Difficulty with fine motor skills
(lowering window, opening car door,
retrieving driver's license, registration & insurance)
- Difficulty with gross motor skills
(exiting your vehicle, performing
FST’s)
- Balance and coordination difficulties
(swaying, falling down, leaning/holding
onto car)
- Disheveled appearance
- Urinated on one’s self
Being suspected of a DUI and being
asked to submit to a battery of tests
in an attempt to prove that you are
DUI can be a scary experience. One’s
nerves may even cause him/her to exhibit
one or more of the factors listed above.
Even if you can attribute it to the
stress of the incident itself, again,
you may be surprised at how things
appear in a police report. Likewise,
even if for example, you tell an officer
that you have a cold and that it has
caused certain symptoms to appear,
he/she may check off the box on the
report forms that indicate that you
are feeling sick but may still check
off the box that says your eyes were
red and watery. For these and
